Proposed Illinois Mold
Law
April, 2004.
Several Illinois state legislators
have recently introduced proposed legislation which would create the
Toxic and Pathogenic Mold Protection Act. It
requires:
1. The Department of Public Health to
consider adopting permissible exposure limits for molds.
2. The Department to adopt standards
for reducing the occurrence of mold contamination in indoor environments.
3. The Department to adopt mold
identification guidelines.
4. The Department to develop
mold abatement standards.
5. A seller of residential,
commercial, or industrial real property to disclose to prospective buyers
the existence of mold in the indoor environment.
6. The authorizes enforcement of the
Department's standards and guidelines by local health authorities and
others.
7. Provides for implementation of the
Act only to the extent that the Department determines that funds are
available for its implementation.
